European Commission amends CLP Regulation – what you need to know
The CLP Regulation (Classification, Labeling and Packaging) covers the classification, labeling and packaging of chemical substances and mixtures in the EU. The European Commission has introduced new hazard classes. Time for companies to adjust to the new reality.
What has changed for you
New hazard classes have been introduced for endocrine disruptors (ED HH and ED ENV); persistent, bioaccumulative, and toxic products (PBT and vPvB); and for persistent, mobile and toxic products (PMT and vPvM). The new hazard classes come with new labeling obligations as well as additional communication and documentation duties along the supply chain. Additional amendments to the CLP Regulation regarding general labeling requirements, C&L notifications, online sales, etc. are expected later this year.
Do the changes affect you?
Review what substances and mixtures you handle and whether they need to be reclassified. If so, you will need to update their safety data sheets (SDSs) and labels.
You may also have to report hazardous mixtures to your national government and provide data on their chemical composition, identity, concentration, toxicology and product category if you manufacture, import and/or distribute such mixtures.
Important deadlines
Regulation (EU) No. 2023/707 took effect on April 20, 2023. It grants the following transition periods for companies to come into compliance with the classification and labeling rules:
- May 1, 2025: For substances placed on the market after May 1, 2025.
- May 1, 2026: For mixtures placed on the market after May 1, 2026.
- Nov. 1, 2026: For substances placed on the market before May 1, 2025.
- May 1, 2028: For mixtures placed on the market before May 1, 2026.
